By creating an account or using Lystia, you agree to these terms. If you do not agree, do not create an account or use the service.
If you are a consumer, these terms do not remove any protection that cannot lawfully be excluded under EU or national consumer law.
2. What Lystia does
Lystia lets users create wishlists, add product information, choose visibility, invite other users, and record gift reservations or purchase status to help avoid duplicate gifts.
Lystia is not a retailer, marketplace, payment service, delivery provider, or party to a purchase between a user and a third-party seller. A wishlist entry or reservation is an expression of intent only; it does not buy, hold, or guarantee an item.
The current service is provided without a monetary charge. If paid features are introduced, their price, billing terms, duration, cancellation rights, and any additional consumer information will be shown before purchase.
3. Eligibility and accounts
- You must be at least 16 years old and legally able to enter this agreement.
- Provide accurate account information and keep it reasonably up to date.
- Keep credentials, session devices, and invitation links secure. Tell us promptly about suspected unauthorised access.
- You are responsible for activity through your account unless it results from our failure to meet a legal or contractual duty.
- Do not sell, transfer, automate, or create accounts for deceptive or abusive purposes.
4. Your content and permissions
You keep ownership of wishlist titles, descriptions, notes, links, and other content you submit. You grant Lystia a non-exclusive, worldwide, royalty-free licence to host, reproduce, format, transmit, and display that content only as reasonably necessary to operate, secure, and improve the service according to your visibility choices.
This licence ends when the content is deleted, except for temporary backup copies, content already lawfully shared with others, and retention required by law.
- Only submit content you have the right to use.
- Respect copyright, trade marks, privacy, confidentiality, image rights, and other people’s personal data.
- Remember that product images and retailer content may belong to third parties and remain subject to their terms.
6. Retailers, links, prices, and images
Product links take you to independent third parties. Lystia does not endorse a seller or verify that a product is safe, lawful, authentic, available, suitable, or accurately described.
Imported titles, images, prices, currencies, and availability are convenience previews and may be incomplete, delayed, or wrong. Check the seller’s page before acting. The seller’s terms, privacy notice, return policy, guarantees, taxes, delivery charges, and consumer remedies govern any purchase.
You are responsible for purchases you choose to make. Lystia does not receive payment through the current service and is not responsible for a seller’s acts or omissions, without limiting liability that the law does not allow us to exclude.
7. Acceptable use
- Do not upload, link to, share, or promote illegal content or activity.
- Do not harass, threaten, exploit, discriminate against, impersonate, or expose another person’s confidential or personal information.
- Do not infringe intellectual-property, privacy, publicity, consumer, or contractual rights.
- Do not distribute malware, probe security, bypass access controls, scrape at harmful scale, overload the service, or interfere with another user.
- Do not use Lystia for spam, fraud, deceptive commercial practices, prohibited goods, money laundering, or evasion of sanctions or law.
- Do not manipulate reservations or access lists without permission.
8. Content moderation and account restrictions
We may investigate reports and restrict visibility, remove content, revoke invitations, suspend features, or suspend or terminate an account when reasonably necessary to address illegal content, a material breach of these terms, security risks, harm to users, or a valid legal order.
We apply restrictions diligently, objectively, and proportionately, considering context, seriousness, recurrence, impact, and available evidence. Decisions are made by authorised personnel; Lystia currently does not use automated systems to make final content-removal or account-termination decisions.
Where legally permitted, we will explain a material restriction and available review options. To report content or challenge a decision, contact privacy@lystia.it with the relevant list or item identifier and reasons. We may withhold information where disclosure would violate law, compromise security, or harm another person.
9. Availability and changes to the service
We aim to keep Lystia available but do not promise uninterrupted or error-free operation. Maintenance, security incidents, provider failures, or events outside reasonable control may affect access.
We may improve, replace, or discontinue features. We will give reasonable advance notice of a material change that negatively affects the service where practical and legally required, and provide a way to end the agreement.
10. Duration, withdrawal, and ending your account
This agreement starts when you create an account and continues until ended. You may stop using Lystia and request account deletion at any time.
If EU consumer withdrawal rules apply, you may withdraw within 14 days after creating the account without giving a reason by sending a clear statement to privacy@lystia.it. Because the current service is free, no refund is due. Your broader right to end the account at any time is unaffected.
On termination, your access ends and content is handled as described in the Privacy Policy. Provisions that by their nature should continue—such as ownership, accrued rights, and mandatory liability rules—remain effective.
11. Lystia intellectual property
The Lystia software, design, brand, logo, and original service materials are owned by us or our licensors. These terms give you a limited, personal, non-exclusive, non-transferable, revocable right to use the service according to this agreement; they do not transfer ownership.
You may not copy, sell, sublicense, reverse engineer where prohibited, or exploit the service beyond what applicable law expressly permits.
12. Responsibility and liability
We provide the service with the care and skill required by applicable law. Nothing in these terms excludes or limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, breach of mandatory consumer rights, data-protection obligations, or any liability that cannot legally be limited.
Subject to those protections, Lystia is not responsible for independent retailers, user-supplied content, voluntary gift arrangements, or losses that were not reasonably foreseeable when the agreement began.
You remain responsible for your content and unlawful use. We will not seek compensation from a consumer beyond losses directly caused by that consumer’s intentional or negligent breach, to the extent permitted by law.
13. Governing law and disputes
These terms are governed by Italian law. If you are an EU/EEA consumer, you also retain the mandatory protections of the country where you habitually live, and proceedings may be brought in the courts available to you under applicable consumer and jurisdiction rules.
Please contact privacy@lystia.it first so we can try to resolve a complaint. Where applicable, you may also use a competent consumer alternative-dispute-resolution body. The former EU Online Dispute Resolution platform was discontinued in 2025 and is therefore not referenced as an available channel.
14. Changes to these terms
We may update these terms for legal, security, technical, or service changes. We will provide reasonable advance notice of material changes through Lystia or another durable channel where required. Changes will not retroactively remove accrued rights.
If you do not accept a material change, you may end the agreement before it takes effect. Continued use after the effective date means the updated terms apply, to the extent permitted by law.
